Resolved: that Councillor Andy Cole be elected Chairperson for the meeting.

Declaration of Disclosable Pecuniary Interest (Standing Order 37) (Agenda item 3)

A Member must declare any disclosable pecuniary interest where it relates to any matter being considered at the meeting. A declaration of a disclosable pecuniary interest should indicate the interest and the agenda item to which it relates. A Member is not permitted to participate in this agenda item by law and should immediately leave the meeting before the start of any debate.

 

If the Member leaves the meeting in respect of a declaration, he or she should ensure that the Chairperson is aware of this before he or she leaves to enable their exit from the meeting to be recorded in the minutes in accordance with Standing Order 37.

Resolved: that the hearing procedure be adopted.

Review of Premises Licence under Licensing Act 2003 - Club Freelove, 40-42 Boulevard, Weston-super-Mare (Agenda item 5) pdf icon PDF 6 MB

Minutes:

The Director of Public Health’s representative outlined the application for review and her report.

 

Avon and Somerset Police Liquor Licensing Officer outlined the reasons for the application for the licence review.

 

The representative from the Residents Association spoke on the matter.

 

The Licence Holder’s representative and the Licence Holder then addressed the committee and answered questions.

 

All parties summed up.

 

Resolved:

 

The Sub-Committee decided to allow the Premises to remain licensed, but to modify the conditions.

 

The Sub-Committee decided all the suggested additional conditions drafted by the parties were appropriate and proportionate in the particular circumstances for the promotion of the licensing objectives and should be incorporated into the Premises Licence. In addition, the Sub-Committee amended the following suggested conditions:

 

1.       The terminal hour of Licensed activities is 12am for all days the premises are open.

 

The Licensing Sub-Committee heard that the terminal hour of licensed activities of other restaurants in the immediate vicinity was 12am, and felt this hour was also reasonable for Club Freelove in the circumstances.

 

2.       Condition 10 under The Prevention of Crime and Disorder objective to be replaced with: There shall be no entry or re-entry for anyone after 10:45pm, except persons permitted outside for the sole purpose of smoking.

 

The Licensing Sub-Committee heard evidence from the residents of Tivoli House concerning noise from club goers outside the premises and felt this condition was reasonable and proportionate in the circumstances and would help to alleviate noise nuisance for residents of nearby residential properties.

 

5.       A maximum of 10 persons shall be allowed outside the premises after 11pm, for the sole purpose of smoking, who will be supervised by SIA staff and identified by use of a hand stamp.

 

The Licensing Sub-Committee heard evidence from the residents of Tivoli House concerning noise from club goers outside the premises and felt this condition was reasonable and proportionate in the circumstances and would help to alleviate noise nuisance for residents of nearby residential properties.
