Declaration of Disclosable Pecuniary Interest (Standing Order 37)

A Member must declare any disclosable pecuniary interest where it relates to any matter being considered at the meeting. A declaration of a disclosable pecuniary interest should indicate the interest and the agenda item to which it relates. A Member is not permitted to participate in this agenda item by law and should immediately leave the meeting before the start of any debate.

 

If the Member leaves the Chamber in respect of a declaration, he or she should ensure that the Chairman is aware of this before he or she leaves to enable their exit from the meeting to be recorded in the minutes in accordance with Standing Order 37.

Application to Review the Premises License from Posh Spice, 86 High Street, Nailsea, BS46 1AS pdf icon PDF 495 KB

Report of the Director of Public Health & Regulatory Services.

Minutes:

The Director of Public Health’s representative outlined the application for review and her report including the report from Home Office Immigration Enforcement requesting a review of the Premises Licence at Posh Spice.

 

The Licence Holder and the License Holder’s daughter spoke on the matter and responded to questions.

 

The representative for the Home Office presented their evidence in response to comments made by the Licence Holder and responded to questions.

 

Resolved:

 

The Sub-Committee decided to revoke the Premises Licence with immediate effect. The Licensing Sub-Committee decided that no additional conditions would be appropriate and proportionate in the particular circumstances, and there was clear evidence of a disregard in promoting or supporting the Licensing objectives under the Licensing Act 2003, in particular. the prevention and crime and disorder and public safety objectives under the Licensing Act 2003.

Urgent business permitted by the Local Government Act 1972

For a matter to be considered as an urgent item, the following question must be addressed: “What harm to the public interest would flow from leaving it until the next meeting”.  If harm can be demonstrated, then it is open to the Chairman to rule that it be considered as urgent.  Otherwise the matter cannot be considered urgent within the statutory provisions.
