Declaration of Disclosable Pecuniary Interest (Standing Order 37)

A Member must declare any disclosable pecuniary interest where it relates to any matter being considered at the meeting. A declaration of a disclosable pecuniary interest should indicate the interest and the agenda item to which it relates. A Member is not permitted to participate in this agenda item by law and should immediately leave the meeting before the start of any debate.

 

If the Member leaves the Chamber in respect of a declaration, he or she should ensure that the Chairman is aware of this before he or she leaves to enable their exit from the meeting to be recorded in the minutes in accordance with Standing Order 37.

The representative of the Director of Public Health reported on the Application to Grant a Premises License for Mendip Activity Centre.

 

The committee heard from the applicant and objector who both presented their respective cases for and against the application. Members asked questions of both the applicant and objector to determine salient points and to clarify details outlined in the application.

 

All parties summed up and then retired to decide on the application.

 

Resolved: The Licensing Sub-Committee decided the application on its own merits and considered the concerns of those who made representations.  The Sub-Committee decided to grant the application with the modification of the supply of alcohol on Sundays will cease at 23:00. In modifying this condition, the Sub-Committee took in to account the representations from the objectors regarding public nuisance. The Standard Conditions and those on the Operating Schedule that will be attached to the licence are necessary to promote the Licensing Objectives under the Licensing Act 2003, namely The Prevention of Crime and Disorder, Public Safety, and Public Nuisance and The Protection of Children from Harm.

 

Therefore, the hours and Licensable activities were agreed as follows:

 

  1. Hours open to the public 09:00 to 20:00 Monday to Sunday
  2. Supply of alcohol 10:00 to 24:00 Monday to Saturday and 10:00 to 23:00 on Sundays
  3. Recorded Music 18:00 to 23:00 Monday to Sunday
  4. Live music 12:00 to 23:00 Monday to Sunday
  5. Films 18:00 to 23:00 Monday to Friday and 12:00 to 23:00 Saturday to Sunday

Urgent business permitted by the Local Government Act 1972

For a matter to be considered as an urgent item, the following question must be addressed: “What harm to the public interest would flow from leaving it until the next meeting”.  If harm can be demonstrated, then it is open to the Chairman to rule that it be considered as urgent.  Otherwise the matter cannot be considered urgent within the statutory provisions.
